Terms & Conditions 

 1. Definitions

1.1 The “Client” means the person/s, organisation or company booking the equipment, with the “Company”.

1.2 The “Company” means Booths2u.

1.3 “Equipment only” hire is the hire of equipment for the Client to operate and supervise themselves.

1.4 “Supervised” hire is the hire of equipment or entertainment accompanied by a representative of the Company to supervise use of the booked equipment.

1.5 “Equipment” means the photo booth, the printer and all accompanying accessories.

1.6 “Booking fee” is the fee paid prior to the event, which shall be deducted from the hire cost.

 

2. Bookings

2.1 By placing an order with the Company, whether it be verbally or in writing, it is deemed that the customer has read, understood, fully agrees with and is bound by these terms and conditions of hire. It is therefore the Client’s responsibility to have read and understood these conditions.

2.3 No compensation will be paid by the Company to the Client in the event of uncontrollable circumstances (such as severe weather conditions, acts of terror, natural disasters, pandemic) which prevent the Company from being able to fulfil their contracted obligations however if available we will offer to reschedule your booking subject to availability.  

2.4 In the event of delayed start, the Company’s liability will be limited to a pro- rata refund based on the delay should it be the company’s fault. No further compensation will be paid irrespective of any loss of earnings. 

2.5 Idle time If you request to have your booth set up earlier than 90 minutes before your start time or taken down later than your end time we charge £25.00 per hour for idle time.

2.6 If the Company are delayed by the Client or Venue and are not able to setup before the agreed start time the Company will not make up this time and end the hire at the previously agreed time unless the Client agrees to pay for any extra time at a rate of £120 per hour.

2.7 In the event that you the client should request to extend the agreed hire time during the event the rate of £120 per hour will apply and payment must be made on site before the extended time begins. 

2.8 Your booking contract is final and fully agreed upon balance payment after this point any changes made by the client such as shortening hire time will not be compensated for.

 

3. Prices, Booking fee & Balance Payments

3.1 All orders will be subject to a £100 Non Refundable booking fee. Such fee will be deducted from the total hire cost. Until such fee is paid your booking will not be confirmed or valid and liable for withdrawal.

3.2 The balance shall be paid in full (and reached the Company’s bank account) 35 days prior to the event start date and act as final conformation of your booked package. Failure to do so will result in the cancelation of your booking and the right for the company to keep any monies paid as compensation. 

3.3 Advertised prices are subject to change without prior notification.

3.5 It is at the Company’s discretion whether they wish to waive clause 3.2 above. Should clause 3.2 above be waived, the company reserves the right to charge interest on all overdue accounts at 10% above its banker’s current interest rate.

 

4. Cancellations

4.1 Any cancelled order is subject to the following cancellation charges and must be made in writing and accepted by the company, if possible we will firstly try to offer a alternative date in exceptional circumstances:

Within 12 weeks prior to event 25% of agreed hire price    Within 8 weeks prior to event 50% of agreed hire price

Within 4 weeks prior to event 75% of agreed hire price    Within 2 weeks prior to event 100% of agreed hire price

4.2 Should you request a change of date a reschedule fee of £45.00 will apply subject to availability and any additional annual/seasonal price changes.

 

5. Equipment

5.1 The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.

5.2 All sizes quoted are approximate

5.3 The Client shall not bring into the Photo booth any food or drink.

5.4 The Company reserves the right to refuse use of the equipment to any person contravening 5.3.

5.5 The Company can not be held responsible for the image quality due to any client not following instruction or equipment failure or damage.

5.6 The Client understands that all print quantities are final also that unlimited prints upgrades carry a fair use of no more than 200 prints in 2hours, 400 prints 3hours, 500 prints 4 hours or 600 prints in 5hours unless otherwise stated.

5.7 The Company can not be held responsible or offer compensation for any lack of use by the client or be made to promote the service at the event.

5.8 Packages agreed and services supplied are stated in your hire agreement can be upgraded at the event but only with instant payment. 

5.9 The client understands that the company will not provide guestbook services unless included in the clients booking, the company will not manage a guestbook or provide prints for one in bronze or silver packages. Should the client provide their own guestbook to be used then the gold or platinum package prices will apply and need to be paid to the company before the hire begins.

 

6. Site Location, Facilities & Conduct

6.1 The Company requires a flat level indoor space 3m wide x 3m deep x 2.1m high and access to a standard 13 amp socket within 5m.

6.2 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.

6.3 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.

6.4 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

6.5 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company. Should the company be obstructed police assistance will be requested and time fees charged to the client.

6.6 Children under the age of 16 may not use the photo booth or props equipment without the supervision of a parent or guardian.  

6.7 A maximum or 6 people to use the photo booth at a time the attendants decision shall be final, if they feel the number or actions of guests in the booth may cause a hazard guests will be removed, failing to follow the attendants instructions will impose term 6.5.

 

7. Liability & Insurance

7.1 The Company is insured and is pleased to show such insurance details upon the Client’s request.

7.2 The Company’s liability insurance covers £10,000,000 

7.3 The Client agrees to indemnify the Company for any damage or theft of the company’s equipment whilst on hire including damage or theft by any venue attendee. The client will also be liable for any further loss of earnings due to the loss, theft or damage. Should the Client not indemnify the Company of such damage/theft within 7 days, the Company will commence legal proceedings.

7.4 The Company accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

7.5 Should the venue suffer fire or water damage whilst the company’s equipment is on site resulting in damage or total loss to the company’s equipment the client will ultimately be liable to indemnify the company within 14 days.

7.6 The company workers are registered self employed, the client will in no way be responsible for tax or national insurance payments for any booking.

7.7 The Company’s liability shall be limited to a refund of any monies paid to the Company in relation to the contracted event excluding the booking fee.

 

8. COPYRIGHT

8.1 The Customer agrees to, and understands the following:

All persons using the Company’s Equipment, at the Customer’s Event hereby give to Booths2u, the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Equipment user. Such use may include, but not be limited to, any social media site or magazine/leaflet for the purposes of illustration, art, promotion, advertising, trade, or for any other purpose.

8.2 Once in the public domain, the Company accepts no liability for the further use, or misuse of the photographic portraits mentioned in 8.1 above, by any third party.

 

9. MISCELLANEOUS TERMS

9.1 If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. 

9.2 Any offer promoting the Company’s services can be withdrawn at any time and is subject to date and delivery restrictions that may result in additional fees that will be defined to the client as necessary when requesting a quote prior to any booking.

 

10. DATA PROTECTION

10.1 All data gathered by the company shell be stored for a maximum of 6 years securely on our system. 

10.2 No personal details will be shared with any third party by the company.

10.3 Images created by the company maybe used for promotion unless the customer opts out of such use.

10.4 Images created by the company with the request of an online share feature such as a gallery will be placed online at the request of the customer. Images where children are clearly identifiable will not be posted to any public gallery. All online usage of images must be opted into by the client on the final booking form this will be the clients consent.

10.5 Should the customer at any point wish for any details or images to be removed or added they can opt in or out of our service.

10.6 Document retention time scales; agreed/competed hires all documentation, corespondents and data to be kept for 5 years. Enquiry documentation and corespondents to be kept for a maximum of 2 years. Our full privacy policy is available at www.booths2u.co.uk
